Division of Assets and Liabilities in Divorce
Once the dissolution of marriage has taken effect, both parties are given the right to divide marital assets and liabilities between themselves. Prior to this, the court must evaluate which properties and debts are considered marital. After this, the couple and their respective lawyers can settle division matters.
The matrimonial home is one of the main assets of the couple. Physically splitting it up is impossible, so other arrangements have to be made. The property can be sold and the proceeds would be divided between the couple. They can also agree that one of them will take possession of the house until he or she remarries. In case they cannot come to an agreement, the court will decide for them.
The debts accumulated during the marriage—joint mortgages, loans, and credit card debts—will also be divided between the couple. Both of them must provide documents that show joint or separate debts so the court can decide which of them must pay for which. Securities such as stocks, retirement, and pension benefits that were activated during the marriage are considered marital property and therefore have to be distributed to both parties. In case only one spouse was working at the time, the non-working spouse still has the right to access the benefits even though he or she did not directly contribute to those.
