What are my rights, what is the next step? Post divorce credit card she was to take.?

I took over the larger amount card, so she would be approved for a house. In our dissolusion agreement, she is to take this account and make all payments.

This Lowe's card is still being mailed to my residence, still listed in my name, and may be affecting my credit. I call customer service to change to her address, but this does not alter whose name the card is under.

I did not want any nastiness from the divorce and have lived up to my end of the agreement. She is legally obligated to absorb the account, make the payments, etc.

Any suggestions on what I do next? Do I have to go through an attorney to get this handled correctly? Any help is appreciated.

Creditors do not care about divorce decrees. Since the card is under your name you are responsible for payments as far as they are concerned.

Now, if she is not making payments you need to work it out with her to pay. If she does not you will have to take her to small claims court. They will have her reimburse you for the payments, but it is unlikely that they would award any damages she caused to your credit. So in the mean time you might want to have her pay you and you pay them. This way you know it is getting paid. You do not need an attorney to file suit against her. You would just go down to the court house and file a Small Claims case. Then take the divorce decree along with the proof that she is not paying when you see the judge.

Once the account is paid off..CLOSE IT.
